CEO Social Media Posts Cause Reg FD Concerns

It is not at all clear that an ad hoc FB post is sufficient public dissemination under Regulation FD – even if it were done on the company’s own FB page. Here, it appears the post was on Netflix CEO Reed Hastings’s personal page. That makes his action similar to the recent tweet by Tesla Motors CEO Elon Musk on his personal Twitter feed.

Am happy to report that Tesla was narrowly cash flow positive last week. Continued improvement expected through year end.

Investors should not be required to follow individual company executives’ social media feeds in order to access public announcements that purport to be from the company itself.
